Aretha Franklin’s Sons Are Still Locked in an Estate Fight Eight Years After Her Death

By Lora·August 28, 2026·1 min read

Eight years after Aretha Franklin died without a formal, lawyer-drafted will, her estate remains caught in probate purgatory. According to reporting from Complex, over 1,400 court filings have accumulated since August 2018, turning the Queen of Soul’s catalog into a protracted legal skirmish among her heirs. A Detroit jury validated a 2014 handwritten document recovered from under couch cushions back in 2023, settling real estate distribution. Yet the core commercial assets remain unresolved. Her sons Kecalf Franklin Cunningham and Ted White II are currently fighting over copyright shares in staples like "Think" and "Dr. Feelgood," as well as dozens of uncataloged reel-to-reel tapes and archival footage stored across 11 Detroit-area facilities. The audio reels might hold unreleased master recordings or alternate mixes. Instead, they sit in standard storage units while at least a dozen lawyers bill hours against the estate. Franklin’s longtime attorney David Bennett noted that the family was initially urged to negotiate privately. Instead, communication collapsed. Leaving an empire to handwritten notes signed with smiley faces was an unforced error by an icon who otherwise maintained strict control over her business. At eight years, this dispute has already surpassed the six-year legal marathon over Prince's estate. Until the brothers settle control over the physical archive and royalties, the vault stays frozen in Oakland County Probate Court.
